Following a fatal scaffolding collapse, NSW Fair Trading permanently disqualified and cancelled the contractor licence of building company, GN Residential Construction Pty Ltd. The regulator also disqualified company director, Nicholas Kodomichalos, for ten years under the Home Building Act 1989 (NSW).

This action follows SafeWork NSW’s prosecution of the company involved in the scaffolding collapse at a residential construction site in Macquarie Park in 2019. In the incident, an 18-year-old apprentice died, and another worker was seriously injured.

GN Residential Construction Pty Ltd. was found guilty and convicted of offences for failing to ensure the health and safety of its workers under section 32 of the Work Health and Safety Act 2011 (NSW).

Our investigation into the incident found:

  • the scaffolding had been heavily overloaded at the time of the collapse
  • there was a history of scaffolding ties being removed and not replaced
  • regular safety walks and inspections of the scaffolding were not conducted.

The NSW Fair Trading investigation revealed that as a result of its conduct, the company and its director were not fit to hold a licence. This result demonstrates the effective information sharing and collaboration between SafeWork NSW and NSW Fair Trading to ensure the safety of workers and consumers.

TLA does not have access to the customer’s credit card number which is encrypted for security purposes. The credit card will be debited at the time of processing the payment. A tax invoice/receipt will be automatically generated and emailed to the customer.

Orders are ordinarily dispatched by Australia Post, Express Post, within seven working days. Five days should be allowed for delivery. This timeframe is indicative only. Every reasonable effort will be made to notify the customer if a delay is expected.

Provided an order has not been dispatched, it may be cancelled in full or part by calling The Landscape Association on (02) 9630 4844. Returns are not accepted by The Landscape Association unless the customer has received an unordered or faulty item, or unless otherwise required under Australian legislation.
